Appendix V: the Constitution of the Colby Student Government Association

PREAMBLE  
We, the students of Colby College, in order to promote the betterment of Colby College, to advance student influence in the College community, and to protect and ensure the rights of all students, do hereby establish this Constitution for the Colby College Student Government Association, hereinafter SGA.   

ARTICLE I: STRUCTURE 
Section A: Membership 
Membership of the SGA shall include and be limited to matriculated students of Colby College.  

Section B: Organization 
The SGA shall be divided into two areas: the Presidents’ Council and the SGA Executive Board. In matters of SGA-related hearings, impeachment processes or other internal judicial matters, the SGA Judiciary Committee shall convene to adjudicate the issue and render a decision which will be forwarded to Presidents’ Council for approval or denial.  The role of the SGA Judiciary Committee shall be described in Article VI of this constitution.    

ARTICLE II: ELECTED AND APPOINTED OFFICIALS 
Section A: SGA President
The SGA President shall: 
  1. Serve as an ex-officio, non-voting member of the Presidents’ Council;
  2. Accept or return for reconsideration all resolutions of the Presidents’ Council at least seven days prior to the next meeting of Presidents’ Council;
  3. Deliver all resolutions of the Presidents’ Council to the College administration, the faculty, the student body, and the general community;  
  4. Serve as student representative to the Colby College Board of Trustees; 
  5. Serve as an ex-officio, non-voting member of all standing committees established by the Presidents’ Council;  
  6. Serve as an ex-officio, non-voting member of all-College committees; 
  7. Appoint a Parliamentarian, a Secretary, Webmaster, Publicity Chair, an Alfond Senior Apartment Complex representative and an off-campus representative, and fill any vacancies that may arise within the Executive Board and Presidents’ Council, with Presidents’ Council approval;  
  8. Invite two faculty representatives to join Presidents’ Council as non-voting members;  
  9. Deliver an annual message on the state of the College to the student body.
  10. Serve as a representative to the monthly Faculty meetings;  
  11. Chair the SGA Executive Board and set a schedule for SGA Executive Board meetings;
  12. Review applications for SGA Judiciary Committee membership; appoint members by April 30 for the following academic year; 
  13. Reside in an on-campus residence hall; excluding Harold and Bibby Alfond Senior Residence Complex;
  14. Receive a stipend by the Presidents' Council at the end of the previous academic year. 
Section B: SGA Vice-President 
The SGA Vice-President shall:  
  1. Serve an ex-officio, non-voting member of the Presidents’ Council, voting in the case of a tie;  
  2. Appoint student representatives to all-College committees and all-College task forces taking into consideration the desires for appointment of all applicants;
  3. Serve as a student representative to the Colby College Board of Trustees;  
  4. Serve as a non-voting, ex-officio member of all standing committees established by the Presidents’ Council;  
  5. Serve as an ex-officio, non-voting member of all-College committees;
  6. Coordinate all SGA elections while chairing the Election Commission;  
  7. Coordinate all hall president evaluations (see Article IV, Section F);
  8. Serve as a representative to the monthly Faculty meetings; 
  9. Assume the office of President of the SGA in the event of the SGA President’s absence or removal from office;
  10. Reside in an on-campus residence hall excluding the Harold and Bibby Alfond Senior Residence;
  11. Receive a stipend to be determined by the Presidents' Council at the end of the  previous academic year. 
Section C: SGA Treasurer
The SGA Treasurer shall:  
  1. Prepare an annual budget (including club allocations) for presentation at the first Presidents’ Council meeting in September; 
  2. Distribute funding of the New Club/Co-Sponsorship Budget as determined by the Executive Board; 
  3. At the request of Presidents’ Council, coordinate auditing procedures of any SGA funded club or organization; 
  4. Deliver a state of the budget address to the Presidents’ Council at the beginning of each semester, and make further reports on the financial status of the SGA as requested  by the Presidents’ Council;
  5. Hold an annual meeting for club leaders at the beginning of the fall semester and assist clubs with financial procedures throughout the academic year; 
  6. Allocate at least 32% of the overall SGA budget to the Student Program Board; 
  7. Promote fiscal responsibility by taking steps to ensure that clubs and organizations do not spend more than their allocated funds. Any club or organization that incurs a debt in a given fiscal year will have the total amount of that debt subtracted from the budget  allocation to that club or organization in the following fiscal year; 
  8. Serve as an ex-officio, non-voting member of the Presidents’ Council;
  9. Receive a stipend to be determined by the Presidents' Council at the end of the previous academic year.
Section D: Hall Presidents
 Each Hall President shall:
  1. Serve as a voting member of Presidents’ Council as the legislative representative for the hall of his/her residence. 
  2. Serve as an appointed member to an all-College committee;
  3. Produce and distribute newsletters twice per month listing Presidents’ Council issues; submit newsletters to the SGA Secretary for filing;
  4. Work with hall staff and attend hall council meetings to resolve issues that arise within the residence hall community.  
Section E: Class Representatives    
  1. Each class shall have two representatives as a pair;
  2. One representative shall serve as a voting member of Presidents’ Council as the legislative representative of his/her class year and serve as member of the Class Council;
  3. The second class representative shall chair a Class Council that will plan a variety of class activities throughout the year and report class recommendations to the voting Class Representative.
  4. Work with the Alumni Office, Dean of Students Office, and Office of Student Activities to further school and class spirit;
  5. Specifically, the Senior Class Representatives will plan Senior Week, help produce the Yearbook, and fulfill other responsibilities assigned by the Director of Student Activities. 
Section F: SGA Parliamentarian    
The SGA Parliamentarian shall: 
  1. Be appointed by the SGA President;  
  2. Run all the meetings of the Presidents’ Council, ruling on all questions of parliamentary procedure;  
  3. Appoint Presidents’ Council members to all Presidents’ Council standing committees, ad hoc committees, and task forces; 
  4. Invite guests to the Presidents’ Council when the Council has requested their presence;  
  5. Decide if it is necessary to call a special meeting of Presidents’ Council for the receipt of SGA Judiciary Committee findings in cases of impeachment; 
  6. Enforce time limits during Presidents’ Council meetings; 
  7. Receive a stipend to be determined by the Presidents' Council at the end of the previous academic year. 
Section G: SGA Secretary  
The SGA Secretary shall: 
  1. Be appointed by the SGA President;  
  2. Be responsible for notification of meetings of the Presidents’ Council;  
  3. Record and promptly distribute the minutes of meetings of the Presidents’ Council;  
  4. Call and record the roll, ruling on attendance questions and informing the SGA President of attendance violations; 
  5. Assist the SGA President in delivering resolutions of the Presidents’ Council; 
  6. Convene the SGA Judiciary Committee within a week upon receipt of a petition or an article of impeachment; 
  7. Notify the student body of every Presidents’ Council meeting by announcing the time, date and location for each meeting; 
  8. Receive a stipend to be determined by the Presidents' Council at the end of the previous academic year. 
Section H: SGA Publicity Chair    
The SGA Publicity Chair shall: 
  1. Be appointed by the SGA President;
  2. Promote and publicize the programming of the SGA; 
  3. Receive a stipend to be determined by the Presidents' Council at the end of the previous academic year. 

Section I: SGA Webmaster   
The SGA Webmaster shall: 
  1. Be appointed by the SGA President; 
  2. Create and maintain the SGA Website, making additions and deletions in a timely manner, as often as necessary; 
  3. Post all meeting schedules, agendas, voting records and minutes on the Website; 
  4. Receive a stipend to be determined by the Presidents' Council at the end of the previous academic year.   

ARTICLE III: SGA EXECUTIVE BOARD 
Section A: Purpose of the SGA Executive Board
The Executive Officers comprise the Executive Board that shall be the executive branch of the SGA. The Executive Board shall meet no less than twice per month, or more frequently at the discretion of the SGA President. The Executive Board meetings exist to facilitate communication between Board members, to share ideas and develop goals for  SGA, and to delegate new tasks and projects as necessary. 

Section B: Composition of the SGA Executive Board  
The Executive Board shall be composed of the SGA President, SGA Vice-President, SGA Treasurer, SGA Secretary, SGA Parliamentarian.  The SGA Publicity Chair and SGA Webmaster shall serve as an ex-officio member of the Executive Board. An invitation may be extended to the Chair or Co-Chairs of the Student Program Board (SPB) to attend SGA Executive meetings. The SGA President will serve as the chair of the Executive Board and, with the approval of the Presidents' Council, may appoint additional members to the Executive Board. All members of the Executive Board shall be enrolled as fulltime students for the entire academic year while in office and must sign the Executive Board Code of Ethics upon joining the Board.   


ARTICLE IV: PRESIDENTS’ COUNCIL  
Section A: Purpose of the Presidents' Council 
The Presidents’ Council shall be the legislative branch of the SGA.  

Section B: Composition of the Presidents' Council   
The Presidents’ Council shall be composed of:  
  1. One hall president from each residence hall or cluster: Anthony-Mitchell-Schupf ,  Averill, Coburn, Colby Gardens, Dana, Drummond, East Quad, Foss, Goddard-Hodgkins, Grossman, The  Heights, Johnson, Leonard, Mary Low, Marriner, Perkins-Wilson, Pierce, Piper,  Sturtevant, Taylor, Treworgy, Woodman, Williams, and West Quad; 
  2. One off-campus representative appointed by the SGA President;  
  3. The SGA President, Vice-President (who shall vote only in the case of a tie), Treasurer, Secretary, and Parliamentarian, who will all be considered ex-officio, non-voting  members;  
  4. One class representative from each class year;  
  5. One member of the Alfond Senior Apartment Complex, appointed by the SGA President; 
  6. Two non-voting faculty representatives, invited by the SGA President;  
  7. The Director of Student Activities, or his/her designee, who shall serve as a nonvoting, ex-officio member.  
Section C: Meetings   
  1. Presidents’ Council Meetings must be held while school is in session.
  2. At the first meeting of the newly elected Presidents’ Council, members shall set regular meeting dates, times, and locations; decide, if desired, the  dress code for Presidents’ Council meetings; decide, if desired, a time limit for discussion of new and old business; and, if desired, a  time limit for each speaker.  
  3. The Presidents’ Council shall meet at least twice per month during the fall and spring semesters;  
  4. Meetings shall be called by the SGA President or by petition of one third of the voting members of the Presidents’ Council.
  5. All Presidents’ Council Meetings shall contain a community forum, directly before Old Business. This forum will be a conduit for community members to speak their views outside the standard Rules of Order. The community forum will last until the final individual who wants to speak has spoken or at least thirty minutes have elapsed, whichever is shorter in duration.
  6. A quorum of the Presidents’ Council shall consist of two thirds of the voting members of the body.  
  7. A roll call vote shall be implemented on all final votes on motions. At the request of any member of Presidents' Council, a roll call vote shall be implemented on any vote.  The results of all roll call votes will be recorded by the SGA Secretary and published by the SGA Webmaster.  
  8. The Parliamentarian shall preside over all meetings. If the Parliamentarian is absent from a meeting, the Vice-President shall preside in his/her place.  
  9. Meetings shall be run according to this Constitution and Robert’s Rules of Order, in that order. 
Section D: Authority
The Presidents’ Council, as the representative voice of the student body, may comment on any issues it deems appropriate, particularly those that directly affect the student body.  Resolutions passed by Presidents’ Council, which initiate change in student policy, shall be sent to the College Affairs Committee and will become policy after obtaining approval from the CAC. The Presidents’ Council shall make recommendations to committees, departments, administrators, or other campus affiliations, but may not set College policy in and of itself. 

Subsection 1: Specific Authorities   
The Presidents’ Council shall be bound solely by this Constitution and the regulations of the College. Thus, it may:  
  1. Approve the SGA budget as allocated by the SGA Treasurer; 
  2. Request a budget review or audit of any SGA-allocated club or function; 
  3. Approve or disapprove all student appointments, on an individual basis, made by the SGA Vice-President to College committees and task forces;  
  4. Approve or disapprove all student appointments, on an individual basis, made by the SGA President to Executive positions and Presidents’ Council vacancies; 
  5. Approve or disapprove the procedures set forth by the Election Commission through which campus-wide student government elections shall be conducted as outlined in Article VII of this document.   
Subsection 2: Relationship with the College Affairs Committee
  1. All policy issues brought to the College Affairs Committee are to be forwarded to the President of the Student Government Association by the Secretary of the College Affairs Committee, to be discussed by the Presidents’ Council. 
  2. The Presidents’ Council may take the following courses of action on these issues. The Presidents’ Council may:
                A.    Waive the right to make a recommendation; 
                B.    Concur with the recommendation of the College Affairs Committee; 
                C.    Dissent with the College Affairs Committee; 
In the event that Presidents' Council dissents with the College Affairs Committee, the SGA Parliamentarian will call for the formation of a conference committee. The SGA President will appoint three voting members of Presidents’ Council, who share the dissenting opinion, to serve on the conference committee, and the Chair of the College Affairs Committee will appoint three members of the College Affairs Committee to serve. If a compromise is reached, it will be forwarded to the Dean of Students for action. If the conference committee cannot reach a compromise, or if the Dean declines to accept the compromise, the SGA President and the Dean will negotiate. If they are unable to resolve the issue, they will ask the President of the College to rule on it. 
  1. The Student Affairs Committee of the Board will be informed of all College Affairs Committee matters pertaining to student life. 
  2. The Presidents’ Council should invite the Chair(s) of the College Affairs Committee to the Presidents’ Council as the non-voting guest(s) when policy matters are discussed.  
  3. The Presidents’ Council and the College Affairs Committee shall exchange minutes to maintain direct communication between the two bodies.
Section E: Motions    
  1. All motions to be considered by the Presidents’ Council shall be presented in writing to the Secretary one week prior to the meeting at which the motion is to be considered unless the Presidents’ Council opts by a majority vote to include a motion at the time of the meeting.
  2. Motions approved by the Presidents’ Council become resolutions of the body.  
  3. Upon approval, resolutions of the Presidents’ Council shall be presented to the SGA President. The SGA President may, at least seven days prior to the next meeting of Presidents’ Council, accept the resolution or return the measure to the Presidents’ Council for reconsideration, with recommendations for change. This is the only occasion where the SGA President may sponsor a motion. The Presidents’ Council may accept or reject the resolution as proposed by the SGA President. Should Presidents’ Council choose not to reject the resolution, the resolution shall stand as resolved by Presidents’ Council.  
  4. The SGA President has the authority to return a motion to Presidents’ Council for reconsideration only once per issue as determined by the Parliamentarian
  5. For all motions, a quorum is necessary.  

Section F: Accountability
  1. A Hall President may be impeached if a percentage of his/her constituency drafts, signs, and delivers a Petition of Impeachment to the SGA Secretary. Refer to Article VIII, Section A of this Constitution for specific impeachment information. 
  2. All Hall Presidents shall be subject to evaluation by the residence hall at least once per semester. The evaluation should address the extent to which the Hall President is responsibly performing his/her duties as outlined by this Constitution. The evaluations should be anonymous, consistent between residence halls, concise, and should provide  space for comments.  The Vice-President shall administer this process.

ARTICLE V: HALL COUNCILS 
Section A: Membership
The Hall Council is composed of the hall president, head resident(s), and any other chairs as determined by the residence hall at its first meeting. 

Section B: Role of Hall Council 
The Residence Hall Council is charged with creating an environment in the hall that supports the growth and learning of all residents.  It is responsible for promoting student rights and ensuring that students adhere to their responsibilities as outlined in the philosophy of residential living found in the student handbook. It is expected that each member of the Hall Council will contribute to this mission within the scope of his/her position. Hall Councils shall meet at least once each month.
Within the framework of other college regulations, halls may modify their own community standards in the following manner: 
  1. The Hall Council may, by a majority vote, place their hall on party moratorium for a specified period of time. Tie votes will be forwarded to the Associate Dean of Students for Residential Life for adjudication in consultation with the President of SGA. 
  2. Quiet hours may be increased by unanimous paper vote of all residents. They cannot be reduced below the College standard. 
  3. Lounge status may be determined in the following manner: 
  1. lounges designated by the College as “substance free” will remain substance  free; 
  2. other lounges that were designated “substance free” by the hall residents for  the previous academic year and received improvements from the College will remain  “substance free” unless voted out by the hall. Improvements to these lounges may be removed if the lounge does not remain substance free;
  3. By a two-thirds vote, a hall may change the status of a hall-designated lounge space for any given amount of time or for the entire year; 
  4. By a two-thirds vote, a hall may prohibit parties/events from taking place on specific weekend nights, or limit the number of events during the semester.

ARTICLE VI: SGA JUDICIARY COMMITTEE
Section A: Purpose 
In matters of SGA-related hearings, impeachment processes or other judicial matters, the SGA Judiciary Committee shall convene to adjudicate the issue and render a decision, which will be forwarded to the Presidents’ Council for approval or denial. The SGA Judiciary Committee is not answerable to the Executive Board or to Presidents’ Council.  The SGA Judiciary Committee is a floating committee whose purpose exists to provide a fair hearing for SGA members who are accused of violating policy or failing to fill the requirements of his/her position. 

Section B: Membership
The SGA Judiciary Committee shall be comprised of five students, plus the Director of Student Activities, serving as an ex-officio, non-voting member. The outgoing SGA President will select a rising senior to serve as the Chair of the committee for the following academic year. The outgoing Chair of the committee and the outgoing SGA President shall appoint four rising seniors to serve on the committee for the following academic year. Members of the committee may be any full-time student, but may not be an HR, an SPB member or a member of SGA. The selection of committee members shall occur after the room-draw process has been completed. Appointments to the Judiciary Committee are not subject to approval by Presidents’ Council.

Section C: Procedures   
The following are customary steps of the Committee:  
  1. Cases before the Committee shall be introduced by the Chair;
  2. The Chair will read the statement concerning the purpose of the committee; 
  3. The Chair will read the charges; 
  4. The accused student will make his/her response to the charge(s) by admitting or denying responsibility; 
  5. The Chair will introduce the case against the accused student;   
  6. The Chair will review any information related to the charges and hear from any complainants or other persons with information about the case; 
  7. The Committee and the accused student may question each person providing information to the Committee; 
  8. The accused student presents any information related to the charges, either directly or through others with information related to the charges; 
  9. The Committee and the complainant may question any person providing information on behalf of the accused student to the Committee;
  10. The Committee, the complainant, or the accused student may ask any final questions, and may present any final information; 
  11. Summary statements may be made by the complainant and the accused student;
  12. The Committee will entertain recommendations concerning the punishment from the complainant, the Chair, and/or the accused student; 
  13. The Committee shall deliberate in private and prepare a written recommendation for Presidents’ Council; 
  14. The Chair shall author a motion to be considered at the next Presidents’ Council meeting, where it will be discussed and voted on.
Section D: Miscellaneous    
  1. If a Judiciary Committee member has a significant relationship to the accused or the complainant, that member shall recuse him/herself from adjudicating that matter. In this case, the Chair of the Judiciary Committee shall appoint a temporary replacement to fill the vacancy in the committee.  The temporary member must fit all eligibility requirements stipulated under section B of this article.
  2. The role of the SGA Judiciary Committee is discussed under Article VII, Recall of Representatives.   

ARTICLE VII: ELECTIONS 
Section A: Election Commission 
The SGA Vice-President will chair the Election Commission, composed of four members of the senior class and the Director of Student Activities, who will serve as an ex-officio, non-voting member.  The Commission is to be appointed by February 1 and approved by Presidents’ Council at the first meeting after February 1.  It will conduct and set the rules and regulations for the election of student government representatives.  They will submit their rules and the dates of the campus-wide election to Presidents’ Council for approval by March 1. The Commission is the final arbiter of any election disputes, and will be considered a College task force for appointment purposes. If the SGA Vice-President is running for an elected office, the Chair of the SGA Judiciary Committee shall chair the Election Commission. 

Section B: General Election
A campus-wide general election will be held in the spring, at least 10 days prior to the first room draw, to elect candidates for SGA executive offices, hall presidents, and class representatives for the sophomore, junior, and senior classes. If no candidate, or pair of candidates, receives a majority of the votes from those voting, a run-off election shall be held between the two candidates, or pairs of candidates, receiving the greatest number of votes. All offices have a term of one academic year. 

Section C: Election of Executive Positions  
The President and Vice-President of the SGA will run as joint candidates. The Treasurer will run independently. The newly elected student government shall assume the duties and responsibilities of office at the last meeting of the Presidents’ Council in the spring.  All registered students, except the Chief Justice of the Colby College Judicial Board, SPB members, and Head Residents, shall be eligible as candidates for elected executive positions. Candidates must be enrolled as a full-time student at the time of election and intend to remain enrolled on campus throughout their term of office, with the exception of January Plan.  

Section D: Election of Hall Presidents 
Election of hall presidents from each hall shall take place each spring in the general election. Vacancies in residence hall presidencies shall be filled by the SGA President with approval by Presidents’ Council. All registered students, except the Chief Justice of the Colby College Judicial Board, SPB members, and Head Residents, shall be eligible as candidates for elected positions. Candidates must be enrolled as full-time students at the time of election. 

Section E: Class Representatives 
Election of two representatives as joint candidates from the sophomore, junior, and senior classes will take place in the spring in the general election. The sophomore, junior, and senior class representatives will run as a pair.  The SGA President will appoint, with the approval of the Presidents’ Council, each freshman class representative in the fall


ARTICLE VIII: RECALL OF REPRESENTATIVES 
Section A: Grounds for Recall   
Any elected or appointed student government representative may be removed from office if recalled by the Presidents’ Council for either of the following reasons: 
  1. Failure to perform duties as outlined in Article II; or  
  2. Violation of College rules including the misuse of SGA funds. 
Additionally, academic or disciplinary probation may be considered grounds for an SGA Judiciary Committee review, upon recommendation by the Dean of Students. Complaints may come from any member of the Presidents’ Council against a student government leader in the form of a resolution for an Article of Impeachment against a representative; or by a Petition of Impeachment with stated grounds written at the top and signed by  twenty percent of the constituency of that official. Complaints against any student government leader should be sent to the SGA Secretary. 

Section B: Process
Upon receipt of either an Article of Impeachment from a voting Presidents’ Council member, a Petition of Impeachment from the constituency, or a request for review from the Dean of Students, the SGA Secretary will convene the SGA Judiciary Committee.  The Judiciary Committee will meet and conduct an investigation of the case as outlined in Article VI of this Constitution. At the next meeting of the Presidents’ Council, or at a special meeting called at the discretion of the Parliamentarian, the Judiciary Committee’s findings and recommendation(s) will be presented in the form of a motion sponsored by the Chair of the Judiciary Committee. The Chair of the Judiciary Committee may not vote on the matter. The Presidents’ Council will deliberate the motion brought forward by the Chair of the Judiciary Committee. The Presidents’ Council will, by a roll call vote, accept, amend, or reject the motion brought forward by the Chair of the Judiciary Committee. Once the decision is voted upon by Presidents’ Council, it shall stand and shall not be altered by any party. The matter may not be sent back to the Judiciary Committee for reconsideration.  

Section C: Sanctions 
Sanctions may include, but not be limited to, a letter of censure, reprimand, loss of office and privileges accompanying the position, and loss of office with a recommended review by the Colby College Judicial Board.  

Section D: Removal from Office 
Hall presidents are subject to automatic removal from office after two unexcused absences from Presidents’ Council. A student who is removed or resigns from his/her position will lose all privileges connected with that position. Absences will be excused at the discretion of the SGA Secretary.  The Secretary has final authority in determining the criterion for an excused absence and will report violations to the SGA President. 

Section E: Replacing Representatives   
  1. Hall presidents and class representatives shall be replaced immediately after an interview process. An official appointment shall be made by the SGA President. 
  2. The SGA President shall be replaced by the SGA Vice-President who will choose a Vice-President; if both the SGA President and SGA Vice-President are removed from office, then a special all-campus election shall be held for their positions. In the interim, a transitional SGA President shall be elected from within the Presidents’ Council; The interim President shall be elected immediately following the SGA President and Vice-President's removal from office and will take office immediately.
  3. In the event of a recall of the SGA President and Vice President, a special all-campus election shall be held two weeks after the vacancy. The procedure is the same as outlined in Article IX. The interim President, selected from and by the Presidents’ Council and who shall not be eligible to run for either position, will coordinate the election and present the winners to Presidents’ Council, which will act as  the final arbiter in all disputes. The new SGA President and Vice-President shall take office at the beginning of the next Presidents' Council meeting following their election.
  4. Members of the SGA Executive Board shall be appointed by the SGA President and approved by the Presidents’ Council;

Article IX - Constitutional Referenda and Amendments
A constitutional referendum may be called by a majority vote of the Presidents' Council or by a petition of two hundred (200) members of the student body to consider amendments. If procedural questions arise, they should be referred to the bylaws rather than amendment to the Constitution. Once proposed, a constitutional referendum must be published with copies posted across campus at least seven (7) days prior to the vote and must be voted on by the student body in a special vote conducted by the SGA Vice-President no later than twenty-one (21) days after the publication. Posting of the amendment must include the proposed amendment and, where appropriate, the current provision being amended.
Ratification requires a two-thirds (2/3rds) majority vote in favor of the amendment(s) with at least one fourth (1/4th) of the student body voting.


Article X – Bylaws
This Constitution maintains the framework for Colby's SGA yet procedural mechanisms are necessary and will come in the form of SGA bylaws that are passed by Presidents' Council as they deem necessary. Bylaws need a majority vote for approval. Records of their existence shall be kept by the SGA Secretary and sent to the Director of Student Activities and the Dean of Students. Bylaws should be presented to the newly elected officers at their first meeting in the spring.


ARTICLE XI: TRUSTEE REPRESENTATION  
The SGA President and Vice-President shall serve as representatives to the Colby College Board of Trustees. They shall also serve as members of either the Student Affairs Committee or Educational Policy Committee of the Board of Trustees. Additional student representation shall be decided by the College President and the Chair of the Board of Trustees.   

ARTICLE XI: CODE OF ETHICS  
Section A:
All members of SGA shall sign the following Code of Ethics;

The Student Government Association of Colby College is committed to initiate positive and realistic change and, through the Presidents’ Council, to provide a forum for the gathering and expression of ideas and concerns from all students. As campus leaders and role models for the student body, we are dedicated to increased campus unity and school spirit; to full and open communication and explanation of events, issues, and proposals for change in College policy; and to the accessibility of views from all students. 
  2. The members of the SGA Executive Board and the Presidents’ Council have a responsibility to the student body to uphold the SGA Constitution, to adhere to all rules and regulations of the College as outlined in the Student Handbook, and to be an active  and positive member of the Colby Community.
  3. The integrity of the SGA must always be maintained by each member. Members will at all times be conscious of their status as representatives of the student body, and will avoid involvement in, or remove themselves from, situations which may tend to lessen the perceived credibility of the SGA. We realize that we are equally accountable for our actions under the aforementioned guidelines of conduct.

Section B: Executive Board Code of Ethics

Constitutional Bylaws:
96-01 All bylaws will be numbered according to the year in which they were created and the order in which they were passed (ex., 96-01, 96-02, etc.). The bylaws will directly succeed the Constitution of the Colby College Student Government Association in all records.
97-13 The newly elected SGA President and Vice-President shall receive the first and second room selections during room draw. The Commons leaders shall receive the first two selections of rooms within their Commons. Hall presidents shall receive the first choice of rooms within their residence hall after hall staff has been assigned. All room selections must be singles, doubles, or triples. [This bylaw has been changed per the recommendations of the Trustees Commission on Residential Life. Leaders who will be in office during their sophomore year will be allowed to choose any single or double. Further, leaders who will be in office during their junior year will be allowed to choose any single, double or triple. Finally, any leader who will be in office their senior year can choose any room with the exception of five-person suites.]
01-01 Starting with the academic year of 2001-2002 and continuing on an annual basis, members of the Presidents' Council who are elected/nominated in the spring should participate in Project Ally during their orientation in the fall. If at all possible, members of Presidents' Council who are elected/nominated during the course of the year in which they serve should also participate in the information session. If Project Ally is not available in the future, the Executive Board of SGA and the Office of Student Activities should work together to find a program of similar substance and strength.
03-01 Members of Colby's student government may not use official emails to endorse anyone in the SGA elections.
03-02 At least one member of a new club must present the club's constitution to the Presidents' Council at one of the bi-monthly meetings before receiving funds from the SGA budget. The Presidents' Council will vote to accept or reject the new club based upon the presentation.
03-03 Clubs must turn in their budget request form to the Student Government Treasurer by no later than April 1. This will allow for the Treasurer to review the requests and consult clubs with any issues before the end of the school year. If forms are not submitted by the April 1 deadline, but are submitted before the end of the school year, the club leader must meet personally with the SGA Treasurer to discuss their budget proposal. If a club does not turn in a budget proposal by the end of the year, the club will lose its club status. Its account would be revoked and the club would have to present itself to the Presidents' Council as a new club during the next school year if funds are desired.
03-04 Registered clubs (those already approved by President's Council / those that already have accounts and have turned in budget proposals) have three weeks from the first day of classes to turn in club leadership forms to the SGA Treasurer. If a club does not submit the forms by the deadline, then funds allocated to that club will be reallocated to the general fund for new clubs and additional expenses. If the club desires to regain those funds, they must present their budget proposal to the President's Council in the same fashion as a new club.
03-05 At the end of each semester each club will present a list of expenses and club events for that semester to the SGA Treasurer. The Treasurer will present a report on organizations that have not spent any funds, who have shown rare activity or inactivity, or who have not turned in forms to the Presidents' Council.
04-01 The SGA Treasurer shall be able to raise objection to any expenditure made by an SGA club.  If an objection is raised the Treasurer shall as part of the executive report of the next President's Council meeting explain the objection.  The Council will then by a 2/3 vote approve the Treasurer's objection.  In the event that the SGA Treasurer raises objection to the club expenditure, the club president will be an ex officio non-voting member on PC for that motion only  Such objections shall be raised when a club's expenditures are deemed by the Treasurer to be wasteful of SGA money and/or not germane to the club's mission.  Examples of wasteful spending include personal gifts to fellow college students, personal groceries/ household items, water coolers, video game systems, etc. If Presidents Council confirms the Treasurer's objection then SGA funds will not be used to reimburse the club.  Club dues or personal funds must be used to pay for such expenditures.  Therefore, any club making a purchase that might be deemed wasteful and/or not germane to the club's mission should seek the treasurer's approval prior to making the purchase. A meeting held by the Treasurer shall inform all clubs of the new policy.  The bylaw shall go into effect at the end of such meeting.
04-02 The SGA Treasurer shall allocate 3,000 dollars at the beginning of each school year to the Garrison-Foster Health Center for H.I.V./A.I.D.S. testing.  The Health Center shall reserve the right to request more money as needed.  Presidents’ Council shall reevaluate this amount on a yearly basis and if needed, establish a new bylaw setting aside the new amount.

If any hall undergoes renovations that alter the size or occupancy designation of any room in the hall, then the College Affairs Committee, with the approval of Presidents’ Council, must reevaluate the specific rooming entitlements for non-tenured Hall Presidents of each class year.            
Furthermore, once elected, each President will choose a room and roommates according to these guidelines prior to room draw.  The President and his or her roommates’ room draw picks will be made available to them.  Then, at room draw, the newly elected President may chose to use his or her own room draw pick, or the pick of a friend, to chose a different room within the same dorm but still according to quota regulations.  At this point, the original room choice that was chosen according to the guidelines outlined above will be released into the room draw pool.  If no new choice is made at room draw, then the President will retain his or her original room choice.  If a roommate from the President’s original room elects to room without the President during the course of room draw, the roommate must be replaced according to quota regulations.  If a roommate of the President’s original room choice elects to live elsewhere, after the President has switched rooms during room draw and the former roommate’s pick has passed, then the roommate will be placed at the bottom of the picking order of his or her class.]

05-02 It shall be the duty of the SGA President and Vice President to carry out to the fullest of their ability, while upholding the SGA Constitution and bylaws, all motions, whether they be opinions, recommendations, or specific policy initiatives, passed by Presidents’ Council. 
05-03 For a newsletter sent out by a dorm president to count as one of the two monthly required newsletters, it must have the dorm president's name, e-mail address, room number, and phone extension.
