What is the role of the General Counsel?

The Office of the General Counsel offers legal representation and counsel to the College.  We advise administrators, faculty and staff in matters pertaining to the College including litigation, employment and student issues, real estate, contracts, environmental issues and government regulation. Our goal is to enable those we represent and counsel to achieve their goals and obtain the ethical and legal standards that align with the values of the College while protecting the College from legal risks and liabilities.

What should I do if I receive correspondence from an attorney regarding a College matter?

Forward the information to the General Counsel. Please contact the General Counsel’s office to provide any and all background information with respect to the matter in question.

What should I do if a Sheriff or Marshall arrives at my office and asks me to accept legal papers on behalf of the College?

You should refuse to accept the papers and direct the individual to the Office of the General Counsel. Please contact the General Counsel’s office to let them know that someone is arriving and what matter it pertains to.

I have been asked to accept service of a complaint in connection with a lawsuit. What should I do?

Refuse to accept the papers and direct the individual to our office.  Unless you have expressly been appointed to do so, do not accept service of any legal documents on behalf of the College.

I have been served a subpoena to appear as a witness in a case. What should I do?

If the matter involves your official duties or activities at the College, contact the Office of the General Counsel as soon as possible. If the case involves a personal matter that is unrelated to College business, contact your personal attorney.

I have received a subpoena asking me to turn over College-related documents. What should I do?

Do not turn over any documents. Contact the Office of General Counsel immediately for assistance. We will work with you to determine the appropriate response.

I received a letter requesting College records under the Freedom of Information Act. Do I have to turn over the records?

The Freedom of Information Act only applies to public institutions. Colby doesn’t have to provide information requested under that statute. Nevertheless, you should immediately forward any letter requesting information under the Freedom of Information Act to our office.

I need legal help for a personal matter. Will the Office of General Counsel help me?

While the Office of General Counsel cannot represent employees in personal matters, we may be able to provide guidance or assist with a referral for your legal matter.
